AN ALBUQUERQUE WOMAN IS SHAKEN TO HER CORE AFTER A NEAR MISS WITH THE RAIL RUNNER THIS MORNING. SHE SAYS THE CROSSING ARM AT MONTANO MALFUNCTIONED AND NEARLY COST HER HER LIFE. BUT RAIL RUNNER OFFICIALS ARE DISPUTING HER CLAIM. SHELTON DODSON HAS BEEN LOOKING INTO THIS... HE’S LIVE IN THE NEWSROOM... SHELTON: WHAT'S CLEAR IS THAT THE CROSSING ARM ON EASTBOUND MONTANO CAME DOWN AND HIT SANDRA OLGUIN'S S-U-V THIS MORNING SECONDS BEFORE THE RAIL RUNNER TRAIN SPED BY. WHAT'S NOT CLEAR IS WHO'S TO BLAME: THE RAILROAD TRACK AT MONTANO IS SOMETHING SANDRA OLGUIN CROSSES EVERYDAY. BUT THIS MORNING SOMETHING HAPPENED HERE THAT SHE HAD NEVER SEEN BEFORE. 'As I was crossing the arm came down and hit my car.' IT CRACKED HER WINDOW AND TORE UP HER LUGGAGE RACK BUT THAT'S NOT WHAT HAS HER SO UPSET TONIGHT. Did you see lights? Did you hear bells? 'No, I didn't hear no bells. I didn't see the lights either.' OLGUIN BELIEVES THE CROSSING BARRIER MALFUNCTIONED — WITH THE ARM COMING DOWN WITHOUT WARNING. BUT RAIL RUNNER OFFICIALS SAY THAT IS SIMPLY IMPOSSIBLE. 'It's one complete system. The arms come down as the bells are dinging and the lights are flashing. The don't happen separately of each other.' THIS AFTERNOON WE WAITED ON THE RAIL RUNNER TO SEE IF THE ARM WAS WORKING CORRECTLY. AND WE FOUND THAT IN THE AFTERNOON IT WAS. BUT OLGUIN SAYS THERE IS NO DOUBT IN HER MIND IT WAS NOT WORKING CORRECTLY THIS MORNING AND NOW SHE IS RE-THINKING HER REGULAR ROUTE TO WORK. 'I am terrified to go across those tracks again.' OLGUIN SAYS SHE IS NOT SEEKING A LAWSUIT -- JUST SOME ANSWERS. ONES THAT WILL PUT HER MIND AT EASE FOR HER AND HER FAMILY. 'We go through there all the time and something has to be done. DESPITE THE HUGE DIFFERENCE OF OPINIONS THE RAIL RUNNER STAFF HAS BEEN IN CONTACT WITH MS. OLGUIN AND THEY PROMISE TO TAKE AN IN DEPTH LOOK AT HER CLAIM. LIVE IN THE NEWSROOM, SHELTON DODSON, EYEWITNESS NEWS FOUR. HE'S A CLEAN-CUT PHYSICIST WITH A HIGH PROFILE JOB -- AND TONIGHT WE'VE LEARNED A LOT MORE ABOUT SUSPECTED DRUNK DRIVER TROY MAZELY. ERIC KAHNERT CONFRONTED MAZELY OUTSIDE COURT TODAY ... HE JOINS US TO EXPLAIN WHY MAZELY'S WIFE AND KIDS SAY HE SHOULD BE LOCKED UP. ERIC? THIS IS DASH CAM VIDEO OF PHYSICIST TROY MAZELY WEAVING DOWN I-25 SOUTH OF PASEO LAST WEDNESDAY WHILE ON HIS WAY TO WORK. POLICE SAY HE WAS 4 TIMES THE LEGAL LIMIT TO DRIVE. WHILE HE DOESN'T FIT THE MOLD OF MOST DRUNK DRIVERS WE SEE -- HIS FAMILY SAYS HE'S DONE THIS BEFORE. THIS IS 44 YEAR OLD TROY MAZELY TRYING TO AVOID US BY WALKING OUT THE SIDE DOOR OF SANDOVAL COUNTY MAGISTRATE COURT. HE WASN'T HAPPY TO BE CONFRONTED ABOUT THIS DASH CAM VIDEO SHOWING HIM ALL OVER THE ROAD AT 9:30 IN THE MORNING. POLICE SAY HE WAS DRUNK TIMES FOUR ... MARIANNE WAS HOPING THIS ARREST WOULD BE PROOF MAZELY VIOLATED HIS PROBATION -- BUT THE D-A DIDN'T HAVE ALL THE PAPERWORK. MEANING JUDGE DELILAH MONTANO- BACA -- WHO WOULDN'T LET OUR CAMERA IN THE COURT -- COULDN'T DECIDE IF MAZELY VIOLATED HIS PROBATION.
Sunday mass ascension canceled

we got word within the last 10 minutes that today’s mass ascension has been skrukd. >> we had about 500, 5 50 balloonists dotting the landscape around albuquerque, and for most of the event — we did have to cancel the flight of the nations on wednesday morning and we had several of the balloon glows canceled because of evening breezes. we were out here for the special shapes glowed yo and that was spectacular. we had a mix of picture perfect weather and nasty stuff. we've been worst in the past. part of the picture. you have to go with it. ballooning is very dependent on the weather and i guess today the weather guys get the blame. >> you have to be with cauti >> you have to be with caution, and the important thing is safety. >> it's so important, because somebody asked how do you steer those things. you really don't. the skilled pilots are adept at going up and down in elevation and catching the wind speeds they want, but when you've got swirling winds like they are today, where they're changing direction, they'll go from 4 miles to 12 miles an hour back to 7 and 10, it's quite dangerous. the other factor is the winds are generally out of the north, so that meeps the balloonists would push toward the city where we don't have the landing space, >> with today's mass ascension being canceled this morning, we have a balloon expert here with us, richard abruzzo owe, balloonist extraordinary. you all know who he is. are you disappointed with today's cancellation. >> yeah, i had some people that bought a ride in an auction, and so i wopt be able to take them up. i'm sure they're does pointed. we'll have to reschedule for after balloon fiesta, which isn't quite the same. >> like i said, you could put a spin on it. you'll get your own vip ride, you'll be by yourself in the skies for when you do get to take them up. >> they'll have the entire sky to themselves. >> do you do hot air ballooning, also world champion helium. what's the difference between the two? >> the gas balloon flights we go very far, both in duration and distance. the flights last as much as three days, and we've made it all the way to the atlantic shore on occasion. >> you've been in dangerous situations, you were injured quite badly, was that two years ago. >> i think four now. >> has it been that long. >> yeah, time flies. yeah, we fly in very difficult conditions because the flights are so long, you're entering complete different weather systems in different parts of the country. it can get challenging. >> this year was america beside challenge balloon race was canceled, and on the day it was announced it was canceled, it didn't seem like the winds were too bad in albuquerque but you have to fore cast out in the future because you're traveling clear across the country. >> yeah, it wasn't bad when we started inflating, and then the winds picked up, so we inflated the balloons in the most difficult conditions we ever have, but we all successfully inflated them, which i think is testament to the crews, their experience, and then the event was canceled. it was discouraging because we had put in so much effort to get the balloons up to get ready to go. the situation where the pilots, where they're doing hot air or gas balloons, they want to fly, but they have to balance the potential risk every time, don't they? >> absolutely. there's that risk/reward calculation, the decion process. this morning is definitely not good, not flyable, so it was to him decision to hold the balloons down. >> for the years when the gas balloon race does get off, tell us what it's like, being up there, up in the air, and you're flying all across the country. that must be amazing. >> hot air flight is remarkable, as anybody that's been in one. the gas balloon is absolutely silence, so you're floating along, it's quite incredible. floating over farm houses at a couple hundred feet and the farmer doesn't know you're going over head because there's no burner sounding, and the length of the flight. it's a true adventure, you don't know where you're going to end up, which is more add vept russ than oth vept russ than other adventures. it's spectacular.

The owner of a downtown Albuquerque nightclub wants to turn the old Pulse club on Central into an underage venue—and the idea is already creating a little controversy. The business owner proposing the idea says no alcohol will be allowed there. He thinks that will help avoid the problems other underage clubs have had in the past, but some still aren’t sold on the idea. It's been dead for a few years, but Jon Chavez wants to revive the Pulse on Central. Chavez said, "we have a zero-tolerance policy against drugs, alcohol, gangs." Chavez is the general manager of Lotus downtown. He and the owner want to turn the Pulse into an underage dance club with no booze allowed. "Albuquerque is lacking a place for young adults to socialize and dance, we want provide that venue," Chavez said Wednesday. Underage clubs have a bad rap in Albuquerque—last year, cops busted Club 7, and found half-naked underage girls mingling with drunk, older men. That club later shut down. Some are worried the new underage club will become a problem spot. "I've had emails sent to me by the neighborhood association, worried about alcohol, drugs, things like that occurring in the parking lot," neighbor James Prasek said. Chavez already has the business license, but needs to get approval from the city to turn the venue into an 18-and-up dance club. He discussed the idea with the Nob Hill Neighborhood Association on Wednesday and handed out letters from two APD officers. A lieutenant writes: "Although this is in no way an official endorsement by the police department, I wanted to express my opinion that Mr. Craig and his staff have proven themselves to be upstanding members of the downtown community." Prasek said, "Why do we want to take the risk as a community to allow something like this after we had lesson after lesson after lesson in regards to underage adults?" Chavez says anyone intoxicated in his club will be banned for good. "They have the right to be concerned with some of the past venues that have been in Albuquerque, we do have experience running 18 and over venues," Chavez said. A public zoning meeting will be held on Tuesday to discuss whether or not the place can become a dance club. Where: Plaza Del Sol Hearing Room, Basement Level (600 2nd Street NW) When: Tuesday, October 20 at 9 a.m.
